To start a vape vending machine business, settle three questions before you spend anything on hardware. Is unattended vape sale legal at the sites you have in mind? Can you get the licences? Are there enough lawful products to fill a machine? In the United States the answer can be yes, but only for adult-only venues and only for FDA-authorised products. In the UK and Australia the answer is no. This guide covers the order of work: law, licences, stock, venues, machine, records and launch. It also says where the business does not work.
Quick answer
- Check the law first. Under US federal law, e-cigarettes may be sold through a vending machine only in facilities where nobody under 21 is present or allowed in at any time (21 CFR 1140.14(b)(3)). States and cities can be stricter.
- Get the licences. Many states and some cities require a tobacco or vapor retailer licence, often one per location. California charges $450 per retail location for applications filed on or after 1 July 2026.
- Stock only authorised products. FDA says the e-cigarettes on its authorised list are the only ones that may be lawfully sold in the US. The list held 48 products as of 28 August 2026.
- Sign adult-only venues such as 21+ bars, nightclubs and casino floors. Write who controls the door into the agreement.
- Specify the machine around the check. Choose the age check, per-transaction limits, remote disable and the record before you choose the cabinet.
- Not in the UK or Australia. The UK bans vape vending machines from 29 October 2026, and Australia allows vape sales only through pharmacies.
Step 1: Confirm the business is legal where you want to trade
This is a summary for planning, not legal advice. Rules change; confirm with the regulator where the machine will stand. Facts are as of October 2026.

The jurisdiction-by-jurisdiction detail, including New Zealand and Canada, is in are vape vending machines legal?. For a US business, the federal floor matters most. The rest of this guide assumes you are starting in a US state that allows vending in adult-only venues.
Step 2: Understand the federal rules every machine must meet
Three federal requirements shape the whole business.
The age is 21. No retailer may sell covered tobacco products, which include e-cigarettes and e-liquids, to anyone under 21 (21 CFR 1140.14(b)(1)). From 30 September 2024, retailers must check photo ID with a date of birth for anyone under 30.
The vending restriction. A retailer “may not sell covered tobacco products with the assistance of any electronic or mechanical device (such as a vending machine), except in facilities where the retailer ensures that no person younger than 21 years of age is present, or permitted to enter, at any time” (21 CFR 1140.14(b)(3)). The rule is about the facility, not the machine. An ID scanner on a machine in a mall does not turn the mall into an adult-only facility.
Who counts as the retailer. The regulation defines a retailer as anyone who sells tobacco products to individuals for personal consumption, “or who operates a facility where vending machines or self-service displays are permitted” (21 CFR 1140.3). That can catch both you, as machine operator, and the venue that hosts the machine. Each of you has a reason to get the door policy right.
There is one point to raise with counsel. The photo-ID requirement for under-30s sits in the same section as the vending rule. In an adult-only venue the ID check normally happens at the door. Whether a door check alone is enough for your set-up, or whether the machine should check again, is a legal judgement. A machine-level check is cheap insurance either way. Step 3: Get state and local licences
Federal law sets the floor. Licensing comes from states, and sometimes from counties and cities. The CDC’s STATE System tracks state e-cigarette licensing rules, including requirements for selling through vending machines, and updates the data quarterly. It is a sensible first stop before you call the state agency.
California is a useful worked example because its rules are explicit:
- Vending location. Business and Professions Code § 22960 prohibits selling cigarettes or tobacco products from vending machines. The exception is machines inside premises holding an on-sale public premises licence from the Department of Alcoholic Beverage Control, at least 15 feet from the entrance. “At least 15 feet away” means inside the licensed premises, not outside them. Local governments may restrict further or ban outright.
- E-cigarettes are included. California’s definition of tobacco product covers electronic devices that deliver nicotine or other vaporised liquids, including e-cigarettes (§ 22950.5).
- Retailer licence. CDTFA’s cigarette and tobacco products retailer licence costs $450 per retail location for new and renewal applications filed on or after 1 July 2026, up from $265 (CDTFA notice L-1021, under AB 573).
- Flavours. California restricts the sale of flavoured tobacco products. The Attorney General’s Unflavored Tobacco List regulations were approved in June 2026. Check the list’s current status before you choose stock.
Questions to put to the state agency before you sign anything:
- Does a machine in a venue need its own licence, or is it covered by the venue’s?
- Does the state have its own vending restriction on top of the federal one?
- Is there a separate tax registration or excise tax for vapor products?
- Do any cities or counties where you plan to trade ban vending, flavours or vapes outright?
Step 4: Decide what you can stock
FDA’s list of authorised e-cigarettes says these are “the only e-cigarettes that may be lawfully sold in the United States”. As of 28 August 2026 it named 48 products from a small number of manufacturers. Anything not on the list is unauthorised, whatever a wholesaler tells you.
FDA enforces this against retailers, not just manufacturers. In a November 2024 release it reported civil money penalty complaints against 79 manufacturers and 175 retailers for distributing or selling unauthorised tobacco products. A vending business that buys cheap disposables from an unclear source is exposed at its first inspection.
What this means in practice:
- Your range is narrow. Plan the machine around a short list of authorised devices, pods and refills, not a wall of flavours.
- Packaging decides the cabinet. Pods and devices come in small boxes that suit a spiral or a narrow cell. Measure the packs before you choose a machine. Our wall-mount vape vending article covers shallow cabinets.
- Keep the paper trail. Hold invoices that tie each restock to an authorised product. They are the evidence that your stock was lawful.
Step 5: Find venues and write the venue agreement
The venue is the business. A machine in a 21+ bar with a staffed door can trade lawfully. The same machine in a building that admits under-21s for some events has a problem on those nights.

Step 6: Specify the machine
Choose the controls before the cabinet. A buyer who starts from “I need a vape vending machine” gets a catalogue answer. A buyer who starts from the rule gets a machine that fits it.

Lead times are 4–6 weeks for a modified standard model and 8–12 weeks for a full custom design, with software customisation scoped separately. The minimum order is one unit for standard models. Step 8: Set up compliance records
If an inspector or the venue asks whether a sale was checked, the record is your answer. Every KioskForce machine writes a transaction record with items, quantities, machine, location, time, order state and receipt ID. For a restricted product, add:
- the age-check method used and whether it passed;
- refused and failed attempts;
- the times sales were enabled and disabled;
- door-open and restock events;
- restock records linked to supplier invoices.

A launch checklist
- Confirm federal, state and local rules for each target venue in writing.
- Apply for the retailer licence(s) and any tax registration.
- Build a stock list from FDA’s authorised products, filtered by state flavour rules.
- Sign venue agreements with door-policy, all-ages and exit clauses.
- Write the machine specification: check method, limits, failure behaviour, records and retention.
- Order the machine and allow the lead time.
- Post the required notices and licence at the point of sale.
- Test the refusal path: under-age attempts, check failure and network loss.
- Train venue staff on staff release and remote disable, if you use them.
- Review the records weekly for the first month.
Where this is the wrong answer
- In the UK and Australia. Neither has a lawful route for an unattended vape vending business. In the UK the ban starts on 29 October 2026.
- In all-ages venues. Convenience stores, malls, gyms, campuses and hotel lobbies fail the US federal adult-only test, however good the machine’s ID check is.
- If the business plan depends on unauthorised disposables. Stock that FDA has not authorised exposes you to enforcement. The machine cannot fix that.
- If your city bans vending or flavours. A local ban overrides a state permission. Check every city and county, not just the state.
- If volume is low. Licence fees, stock and restock visits are fixed costs. A venue that sells a handful of units a week does not cover them.

Do I need a licence to run a vape vending machine?
In most US states, yes. Many states require a tobacco, vapor or nicotine retailer licence or permit, and some cities and counties add their own. A convenience store or a mall admits all ages, so it does not qualify, even if the machine itself scans ID. What vapes am I allowed to stock in a US vending machine?
Only products with an FDA marketing authorisation. FDA keeps a public list of authorised e-cigarettes and says these are the only e-cigarettes that may be lawfully sold in the United States. In practice the venue controls the door, so the venue agreement should say who checks ID at entry, what happens when under-21s are admitted for an event, and that the machine is switched off when they are.
Can I start a vape vending business in the UK or Australia?
No. In the UK, the Tobacco and Vapes Act 2026 makes it an offence, from 29 October 2026, to have a vape or nicotine product vending machine on premises you manage or control. The only exception, in England and Wales, is a narrow one for inpatient areas of mental health hospitals. In Australia, since 1 July 2024 the sale of non-therapeutic and disposable vapes has been banned, and therapeutic vapes are available only from pharmacies. Neither market has a route for an unattended vape vending business.
How much does it cost to start a vape vending business?
The machine is usually not the largest line. What records should a vape vending operator keep?
Enough to show that every sale was age-checked, and no more identity data than the rule needs. A sensible minimum is the transaction record with machine, location, time, item and quantity, plus the result of the age check. Add the method used, failed or refused attempts, door and service events, and the dates the machine was enabled or disabled. Keep restock records tied to supplier invoices so you can show every product was authorised. Store ID images only if a law requires it.
