Are Vape Vending Machines Legal? Rules by Country and US State

Vape vending machines are legal only in some places, and almost always only at adult-only sites; the rule is set by the jurisdiction where the machine stands. In the United States, federal regulation (21 CFR 1140.14) allows e-cigarettes to be sold from a vending machine only in a facility where nobody under 21 is present or permitted to enter at any time. States can be stricter: California confines it to premises with an on-sale public premises licence and lets cities and counties ban it outright. In the UK, the Tobacco and Vapes Act 2026 makes it an offence to have a vape or nicotine product vending machine available for use from 29 October 2026. Australia has allowed vapes only through pharmacies since 1 July 2024. Germany permits vending with a technical age check, and New Zealand only with staff activating each sale.

Whether a vape vending machine is legal depends on three things: the product, the method of sale and the site. Most of the world’s rules allow the product but restrict the method. In the US, federal law allows vape vending only in facilities that admit nobody under 21, and several states ban it outright. The UK bans it from 29 October 2026. Australia allows no vape sales outside pharmacies. A few places, including Germany and New Zealand, allow it with conditions. The table below lists the main jurisdictions, and each one is explained after it with its source.

Quick answer

  • Everywhere: a machine that is allowed must still sell only lawful products, to adults, with the signage and records the local rule requires.

This is a summary for planning, not legal advice. Rules change; confirm with the regulator where the machine will stand. All facts are as of October 2026.

The three questions that decide legality

  1. Is the product lawful to sell here at all? In the US an e-cigarette needs FDA marketing authorisation. In Australia vapes are lawful only through pharmacies for therapeutic use.
  2. Is vending a permitted method of sale for that product? This is where most bans sit. Many laws ban vending machines specifically, separately from the minimum-age rule.
  3. Is this site one where the exception applies? Exceptions are usually tied to the site, for example an adult-only facility, a licensed bar or a place not open to the public, rather than to the machine’s own features.

A machine that clears question 3 still fails if question 1 or 2 fails. That is why we ask for the regulation before the cabinet design.

United States: the federal rule

Three federal provisions shape every US project.

Tobacco 21. On 20 December 2019 federal law raised the minimum age of sale for all tobacco products, e-cigarettes included, from 18 to 21. FDA says it is illegal for a retailer to sell any tobacco product to anyone under 21, and that the federal minimum applies to all retailers “with no exceptions”. Since FDA’s 2024 rule, retailers must check photo ID of anyone under 30.

The vending rule. 21 CFR 1140.14(b)(3) covers “covered tobacco products”, which includes e-cigarettes. It states that a retailer “may not sell covered tobacco products with the assistance of any electronic or mechanical device (such as a vending machine), except in facilities where the retailer ensures that no person younger than 21 years of age is present, or permitted to enter, at any time.” Cigarettes and smokeless tobacco have the same condition in § 1140.16(c).

The condition is about the facility. A bar that never admits under-21s can qualify. A convenience store, a gas station or a mall corridor cannot, because under-21s can walk in. A machine that scans ID does not change who can enter the building. Some sellers argue an ID-scanning machine satisfies the rule anyway. We are not aware of FDA guidance that supports this, and the text does not say so. If your business plan depends on it, get FDA’s view or your counsel’s in writing first.

Authorised products. FDA’s list of authorised e-cigarettes says that the products on it are “the only e-cigarettes that may be lawfully sold in the United States”. As of 28 August 2026 it listed 48 products. A machine stocked with unauthorised products is unlawful whatever its age gate does.

State and local tobacco laws apply on top of the federal rule and can be more restrictive. That is the next layer.

United States: state and local examples

US states regulate vending separately, and the variation is wide. Three examples show the range:

  • Virginia shows why the current text matters. Until 30 September 2026, § 18.2-371.2 banned vending-machine sales of retail tobacco products, a definition that covered electronic smoking devices, with no adult-venue exception. The version in force from 1 October 2026 says “No person shall sell tobacco products or hemp products intended for smoking from a vending machine” and takes its definition of tobacco product from the state tax code (§ 58.1-1021.01), which defines nicotine vapor products separately. Confirm with Virginia’s regulator how vapes are treated before relying on either reading.
  • California prohibits tobacco-product vending except inside premises holding an on-sale public premises licence, essentially bars where minors are not admitted, and at least 15 feet inside the entrance (Bus. & Prof. Code § 22960). California’s definition of tobacco product includes electronic devices that deliver nicotine or other vaporised liquids (§ 22950.5). Section 22960(c) lets local governments restrict vending further or ban it completely. Each retail location also needs a state tobacco retailer licence, and the fee for applications from 1 July 2026 is USD 450 per location, renewed annually (§§ 22972, 22973).
  • Missouri applies its vending rule to “tobacco products, alternative nicotine products, or vapor products”. Machines must be in the unobstructed line of sight of a supervising adult or fitted with a staff-activated locking device, except in areas where minors are not permitted (RSMo § 407.931). The state text refers to under-18s, but the federal 21 minimum and the federal adult-only facility condition still apply in Missouri. Meeting the state rule does not meet the federal one.

Cities and counties add another layer: local retailer licences, flavour restrictions and, in some places, outright vending bans. Check the county and city as well as the state.

United Kingdom: banned from 29 October 2026

The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. Its sale and distribution provisions, Parts 1 to 4, come into force six months later, on 29 October 2026. Some licensing and age-of-sale measures are on separate dates (s. 175). The vending provisions are:

  • England and Wales, section 12: a person commits an offence if they manage or control premises “on which a vape vending machine or a nicotine product vending machine is available for use”. The Act exempts a vape vending machine in a mental health hospital, in an area intended wholly or mainly for inpatients. The GOV.UK guidance adds that a machine used as secure storage, dispensing only to staff who then make the sale, is outside the ban. The penalty is a fine up to level 4 on the standard scale.
  • Scotland, section 61: replaces section 9 of the Tobacco and Primary Medical Services (Scotland) Act 2010, so that “prohibited vending machine” covers vaping products and nicotine products as well as tobacco.
  • Northern Ireland, section 82: inserts Article 4J into the Health and Personal Social Services (Northern Ireland) Order 1978, creating the same offence.

“Nicotine product” in the Act reaches beyond vapes, so nicotine pouch vending is caught too. See nicotine pouch vending machines. Tobacco vending has been banned in England since 1 October 2011 under the Protection from Tobacco (Sales from Vending Machines) (England) Regulations 2010. The 2026 Act also contains its own tobacco vending offence (s. 3).

In short, from 29 October 2026 there is no customer-operated UK vape vending machine you can lawfully run, whatever age check it uses.

European Union: decided country by country

Vending rules for tobacco and e-cigarettes are set nationally, so check each member state separately. Germany is a useful example of the conditional model. Section 10(2) of the Jugendschutzgesetz (Youth Protection Act) says tobacco products and other nicotine-containing products may not be offered in vending machines in public. The exceptions are a machine installed somewhere inaccessible to minors, or one where technical devices or constant supervision ensure that children and young people cannot take the products. Section 10(4) extends this to nicotine-free products such as e-cigarettes and e-shishas. In Germany the age check on the machine itself does count, which is not true under the US federal rule.

Australia: pharmacy only

Australia’s reforms under the Therapeutic Goods and Other Legislation Amendment (Vaping Reforms) Act 2024 took effect on 1 July 2024. The TGA’s summary: “non-pharmacy retailers, such as tobacconists, vape shops and convenience stores, cannot sell any type of vape”, with or without nicotine. Disposable single-use vapes are unlawful. From 1 October 2024, adults can buy therapeutic vapes of 20 mg/mL nicotine or less from a pharmacy without a prescription, “where a pharmacist assesses this to be clinically appropriate”.

So there is no vending route for vapes in Australia. That supply depends on a pharmacist’s clinical judgement, which an unattended machine cannot provide. If you are a pharmacy thinking about a pharmacist-released pickup locker for vapes that have already been dispensed, take that to your state or territory pharmacy regulator first. We have not seen it approved and do not suggest it is allowed.

Canada: provincial rules decide

Federally, section 12 of the Tobacco and Vaping Products Act prohibits furnishing tobacco products from a dispensing device except in places the public does not reasonably have access to, or in a bar, tavern or beverage room with a prescribed security mechanism. A 2018 amendment that would extend section 12 to vaping products is listed on the Justice Laws site as not yet in force (Act current to 21 September 2026). In practice the provinces decide vape vending, and their minimum ages and rules differ. Check the law of your own province before you plan a machine.

New Zealand: staff activation in public places

New Zealand’s Smokefree Environments and Regulated Products Act 1990 covers vaping products as “regulated products”. Section 47 says an automatic vending machine that can dispense them must not be located in a public place. The exception is a machine where no sale can happen unless the seller or their employee activates it, and the activating device is close to the machine with a direct line of sight to the buyer. Section 46 requires that no part of the product or its packaging is visible from outside the machine. Section 48 requires the machine to display any required health messages. The minimum age is 18 (s. 40). The NZ model is a staff-release machine by law.

What this means if you are buying a machine

Where the law is unclear

  • ID-scanning machines in US all-ages retail. As above, the federal text ties the exception to the facility. Treat any claim otherwise as unproven until FDA or your counsel confirms it.
  • Local ordinances. City and county rules in the US change often and are not collected in one place. Check with the local health department.
  • Nicotine-free and non-tobacco nicotine products. The UK, Germany, Australia and California all reach beyond nicotine-containing tobacco-derived products. Other places may not. Ask rather than assume.
  • Commencement dates. The UK ban is dated 29 October 2026. Other Tobacco and Vapes Act measures commence on different dates set by ministers. Re-check before any UK project, including one for a different product category.

No. Since 1 July 2024, non-pharmacy retailers such as tobacconists, vape shops and convenience stores cannot sell any type of vape, with or without nicotine. Vapes are supplied only through pharmacies for smoking cessation or managing nicotine dependence. Since 1 October 2024, adults can buy therapeutic vapes of 20 mg/mL nicotine or less from a pharmacy without a prescription, but only where a pharmacist assesses it as clinically appropriate. A vending machine cannot perform that consultation.

Not under the US federal rule as written. The federal exception in 21 CFR 1140.14(b)(3) depends on the facility: no one under 21 present or permitted to enter at any time. The text has no exception for a machine that checks ID itself. Some sellers market ID-scanning machines for all-ages retail. We are not aware of FDA guidance that accepts this, so get FDA’s view or your counsel’s before you rely on it. Elsewhere it depends on the wording. Germany, for example, accepts technical measures that stop minors taking the product.

Why can’t I find a vape vending machine near me?

Because the places they are allowed are places many people do not go, or cannot enter. In the US a machine can only stand in a facility that admits nobody under 21 at any time, such as an adult-only bar, club or casino floor. Several states and many local governments ban them outright. They are not permitted in Australia, and from 29 October 2026 they are prohibited across the UK. Where one exists, it will usually be inside a licensed venue rather than on a street or in a shop.

Are nicotine-free vapes covered by vending machine rules?

Often, yes, but check the wording in each place. The UK Act applies to vaping products, not only to those containing nicotine. Germany’s Youth Protection Act extends its vending restriction to nicotine-free e-cigarettes. Australia’s pharmacy-only rule covers vapes with nicotine and with zero nicotine. California’s definition of tobacco product includes any electronic device that delivers nicotine or other vaporised liquids. Assume nicotine-free devices are restricted unless your regulator confirms otherwise.
