How Does Age Verification Work in Vending Machines in 2026?
Age verification in a vending machine is not a single gadget — it is three separate decisions (the check, the record, and the failure behaviour) matched to the law where the machine stands. Three mechanisms are in use: placement restriction, which puts the machine somewhere under-21s cannot reach; access control, a lock or remote release controlled by the operator; and active verification, an ID scan at the machine or a check done off the machine through an app, QR code or SMS. Federal law sets the purchase age at 21 and permits only FDA-authorised vape products. The states then diverge: Ohio allows vending only in adult-only facilities; Virginia requires a locking device controlled by the operator; Nevada is the only state that mandates electronic ID scanning. The operator — not the machine — carries the liability for every under-age sale, regardless of malfunction.
Age verification is not a feature you buy.

The three mechanisms
Every age-verified machine in the field uses one or more of these.

Placement restriction. The age gate is the door, not the machine. Ohio Revised Code §2927.02 is the purest form: a tobacco or vapour machine may only stand in a facility, or an area of a facility, where no person under 21 is present or permitted to enter. Bars, adult lounges, casinos — the venue itself is the check.

Access control. A lock or remote release the operator or venue staff controls. Virginia Code §18.2-371.2(B) writes this one into law: any machine outside an adult-only space must be “equipped with a locking device controlled by the operator.” A bartender checks ID, then releases the vend.

Active verification. The check happens at or before the machine. An ID document scanner reads the date of birth. Or the customer verifies on their own phone — an app, a QR code, an SMS code — and the machine releases the product on the resulting token.
Most real deployments stack two of the three. Adult-only placement plus staff release is the workhorse for bars and clubs.
The state decides which check counts
Not the machine.
Not the manufacturer.
Here is how three very different states drew the line in 2026.

The differences are not cosmetic.
Ohio makes the location do the work. Virginia makes the lock do the work. Nevada makes the scanner do the work.
A machine that is compliant in a Columbus bar can be non-compliant in a Richmond convenience store, through no fault of the machine.
The liability is yours
Here is the part operators skip.
Federal Tobacco 21 sets the floor at age 21. The FDA only allows vapour products with a Premarket Tobacco Application (PMTA) marketing order to be sold at all.
But the operator carries the burden of proving the check worked.
Ohio law holds the operator liable “regardless of machine malfunction.” Virginia escalates civil fines from $100 to $200 to $500, and its vape directory law adds a $1,000-per-product-per-day penalty for stocking any SKU not on the official list (Va. Code §59.1-293.16).
One more number worth knowing: roughly eleven states — Arizona, Connecticut, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Texas, Utah, West Virginia and New York — treat a performed ID scan as an affirmative defence. The scan does not have to be mandated for it to protect you. It has to have happened.
What to specify before you buy

The check. Which of the three mechanisms does your regulator accept for this product at this site?

The record. What gets written down about each check — who, what, when — and how long it is kept.

The failure behaviour. What the machine does when the check fails, or when the network is down and an external service cannot be reached. For a restricted item, the correct answer is usually refuse the vend.
